SimpliFiber Network Management
These Network Terms of Service ("Network Terms") govern the use of the SimpliFiber network infrastructure and related services ("Network Services") provided by SimpliFiber LLC, located at 748 W Heritage Park Blvd #201, Layton, Utah 84041, United States ("SimpliFiber"). The Network Services include the fiber optic infrastructure, equipment, and connectivity used to deliver SimpliFiber Internet, Phone, and common area Wi-Fi services (collectively, the "Services") to your residence or property. These Network Terms are incorporated into the SimpliFiber Residential Terms of Service. In the event of any conflict between the SimpliFiber Residential Terms of Service and these Network Terms, these Network Terms will control with respect to the Network Services.
By using the Services, you agree to these Network Terms. If you do not agree with these Network Terms, you should discontinue using the Services and contact SimpliFiber to terminate your account.
Network Access and Use
SimpliFiber grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Network Services solely for the purpose of receiving the Services at the address specified in your SimpliFiber account, in accordance with the SimpliFiber Residential Terms of Service and Acceptable Use Policy. You agree not to:
- Use the Network Services for any purpose other than receiving the Services at your designated address.
- Modify, tamper with, or attempt to access any part of the SimpliFiber network infrastructure, including but not limited to fiber optic cables, network equipment, or connectivity systems, unless expressly authorized by SimpliFiber in writing.
- Share, resell, or provide access to the Network Services to any third party outside your residence or property, as prohibited by the SimpliFiber Acceptable Use Policy.
Equipment Ownership and Maintenance
Unless explicitly stated otherwise on getsimplifiber.com, all network equipment provided by SimpliFiber, including but not limited to the Fiber Jack, routers, modems, phone boxes, and associated cabling or infrastructure components (collectively, "Network Equipment"), remains the property of SimpliFiber. You agree to:
- Use Network Equipment solely for the purpose of accessing the Services.
- Allow SimpliFiber or its authorized agents access to your residence or property to install, maintain, repair, or replace Network Equipment, as outlined in the SimpliFiber Residential Terms of Service.
- Return all Network Equipment (except purchased equipment, Fiber Jack, or inside wiring) in working condition within sixty (60) days of Service termination, as specified in the SimpliFiber Residential Terms of Service. Failure to do so may result in replacement fees, as outlined in the SimpliFiber Fee Schedule.
SimpliFiber warrants Network Equipment against defects in materials and workmanship during the active Service period, unless damaged by you, as detailed in the SimpliFiber Warranty Policy.
Network Installation and Access
SimpliFiber or its authorized agents may require access to your residence or property to install, maintain, or repair Network Equipment or infrastructure. This may include:
- Installing fiber optic cables or other network components on or within your property.
- Affixing Network Equipment to the exterior or interior of your residence at reasonable locations, as determined by SimpliFiber.
- Using existing wiring or facilities to connect the Services.
If you rent or do not own your residence or property, you may be required to provide written evidence of permission from the property owner or manager for SimpliFiber to perform installation or maintenance activities. SimpliFiber is not responsible for any agreements between you and property owners or managers, as stated in the SimpliFiber Residential Terms of Service.
Fees and Charges
Fees related to the Network Services, including installation, construction, or replacement fees for Network Equipment, are outlined in the SimpliFiber Fee Schedule. You agree to pay any applicable fees, including taxes, as specified in your billing statement. If Network Equipment is lost, damaged, or not returned as required, you may be charged replacement fees, as detailed in the SimpliFiber Fee Schedule.
Network Performance and Limitations
SimpliFiber strives to provide reliable Network Services but does not guarantee uninterrupted, error-free, or continuous access, as outlined in the SimpliFiber Uptime Agreement. Network performance may be affected by factors such as maintenance, network congestion, technical issues, or external events beyond SimpliFiber’s control. SimpliFiber is not liable for any damages, losses, or inconveniences resulting from network interruptions or degradation.
Prohibited Activities
In addition to the restrictions in the SimpliFiber Acceptable Use Policy, you agree not to:
- Attempt to bypass, disable, or interfere with any security or operational features of the Network Services or Network Equipment.
- Use the Network Services to operate servers for commercial purposes, unless explicitly permitted by SimpliFiber in writing.
- Engage in any activity that disrupts or degrades the SimpliFiber network, including excessive bandwidth usage that adversely affects other customers.
Violation of these Network Terms or the SimpliFiber Acceptable Use Policy may result in suspension or termination of your Services, at SimpliFiber’s sole discretion, with or without notice.
Changes to Network Terms
SimpliFiber may modify these Network Terms at its discretion. Changes will not apply retroactively and will take effect no sooner than fourteen (14) days after posting on getsimplifiber.com, except for changes addressing new Service functions or legal requirements, which may take effect immediately. If you do not agree to the modified Network Terms, you should discontinue using the Services and contact SimpliFiber to terminate your account.
Dispute Resolution
Any disputes arising under these Network Terms will be resolved in accordance with the dispute resolution provisions in the SimpliFiber Residential Terms of Service, which include binding arbitration conducted by the American Arbitration Association (AAA).
